MotusAcademy values donor trust, transparency, and responsible stewardship. This Donation Policy explains how contributions are processed, how recurring gifts are managed, and how refund requests are handled.
- Purpose
This Donation Policy applies to donations, sponsorships, recurring gifts, and other supporter contributions made to or through MotusAcademy Foundation SD via the MotusAcademy website or related donation channels.
The purpose of this policy is to promote clarity for donors, support responsible stewardship, and provide a fair and consistent framework for handling contributions. Public-facing gift acceptance policies are widely considered a nonprofit best practice because they help manage expectations, support transparency, and reduce operational and legal risk. Where a donation is processed through a third-party payment platform or event-registration system acting on behalf of MotusAcademy Foundation SD, that provider may also process transaction data as part of the payment flow.
- Types of Contributions We May Accept
MotusAcademy Foundation SD may accept, at its discretion, contributions in forms such as:
- one-time online donations;
- recurring monthly or annual donations;
- sponsorships;
- event or gala support;
- grants;
- programme-directed gifts;
- certain in-kind contributions, where appropriate and operationally feasible.
We reserve the right to decline, return, or refuse any contribution that is not consistent with our mission, legal obligations, operational capacity, or ethical standards. The National Council of Nonprofits notes that some gifts may create more cost, risk, or administrative burden than value, and that a written policy helps organisations handle those situations consistently. - Restricted and Unrestricted Gifts
Unless a donation is explicitly accepted for a specific approved purpose, gifts will generally be treated as unrestrictedand may be used where most needed to support MotusAcademy Foundation SD’s mission and operations.
Where a donor indicates a preferred designation or restriction, we will make reasonable efforts to honour that designation if:
- the restriction is lawful;
- it is consistent with our mission and policies; and
- the restricted use is practical and accepted by MotusAcademy Foundation SD.
If a restricted purpose becomes impossible, impractical, obsolete, or no longer aligned with operational realities, MotusAcademy Foundation SD may redirect the funds to a substantially similar purpose, subject to applicable law and good-faith stewardship principles.
- Donation Processing
Donations may be processed through online payment forms, event platforms, payment processors, bank transfer, or other approved methods. By submitting a donation, the donor represents that:
- the payment method used is valid and authorised;
- the donor is authorised to use that payment method;
- the information provided is accurate to the best of the donor’s knowledge.
MotusAcademy Foundation SD will make reasonable efforts to ensure donations are processed securely and recorded accurately, but no electronic system can be guaranteed to be error-free or uninterrupted.
- Donation Receipts and Acknowledgements
MotusAcademy Foundation SD will make reasonable efforts to provide donors with an acknowledgement or receipt for completed donations.
For U.S. tax purposes, the IRS states that a donor generally may deduct a charitable contribution of $250 or more only if the donor obtains a written acknowledgment from the charitable organisation. The IRS also states that charities must provide a written disclosure statement for any quid pro quo contribution over $75, meaning a payment that is partly a donation and partly in exchange for goods or services. Accordingly:
- we will seek to provide written acknowledgements for eligible donations;
- where a payment includes goods, services, tickets, tables, benefits, or sponsorship components, we may describe the portion, if any, that may not qualify as a charitable contribution;
- donors remain responsible for consulting their own tax advisers regarding deductibility, valuation, reporting, and substantiation.
- Recurring Donations
If recurring donations are offered, donors will be informed of:
- the donation amount;
- the billing frequency;
- the method of payment;
- how to cancel future recurring charges.
MotusAcademy Foundation SD aims to make recurring giving straightforward to manage. Donors may request cancellation of future recurring donations by following the cancellation method provided at sign-up or by contacting info@motusacademy.org.
This approach is consistent with the FTC’s “click-to-cancel” direction that recurring charges should be as easy to stop as they are to start. The FTC announced a final rule intended to make cancellation of recurring subscriptions and memberships easier for consumers, and its rulemaking materials continue to emphasise simple cancellation pathways. Cancellation of future recurring charges does not normally entitle the donor to a refund of charges already processed, except as described in the refund section below.
- Refund Policy
As a general rule, donations are voluntary and non-refundable once processed.
However, MotusAcademy Foundation SD may review refund requests in limited circumstances, including:
- duplicate donations;
- an incorrect donation amount entered in error;
- an unauthorised or fraudulent transaction;
- a technical processing error;
- other exceptional circumstances reviewed at our discretion.
Refund requests should be submitted as soon as possible and preferably within 14 days of the transaction date.
To request a refund, donors should email info@motusacademy.org and include:
- full name;
- contact email;
- donation date;
- donation amount;
- payment method used;
- a brief explanation of the request.
If a refund is approved, it will generally be issued to the original payment method where feasible. MotusAcademy Foundation SD reserves the right to request additional information before making a decision.
- Event Payments, Sponsorships, and Benefit-Linked Contributions
Payments connected to events, gala tables, sponsorship packages, registrations, auctions, or donor benefits may be subject to additional terms, including:
- event cancellation terms;
- transfer or substitution terms;
- sponsorship fulfilment terms;
- quid pro quo disclosure requirements.
Where goods, services, or donor benefits are provided in exchange for payment, MotusAcademy Foundation SD may identify the estimated fair market value of those benefits where appropriate so that the charitable portion, if any, can be distinguished. The IRS specifically requires written disclosure for quid pro quo contributions over $75. (IRS)
- Non-Cash and In-Kind Gifts
MotusAcademy Foundation SD may consider non-cash or in-kind contributions on a case-by-case basis. These may include equipment, services, software, supplies, or other assets.
We reserve the right to decline in-kind gifts that:
- are not reasonably usable for our mission;
- impose disproportionate storage, maintenance, compliance, disposal, or liability burdens;
- involve unclear ownership, valuation, or legal restrictions.
The National Council of Nonprofits specifically notes that some non-cash gifts can create burdens or obligations that an organisation is not prepared to manage, which is one reason a written gift acceptance policy is considered a best practice. (National Council of Nonprofits)
MotusAcademy Foundation SD does not provide appraisals or tax valuations for donated property. Donors should obtain their own professional advice regarding valuation and deductibility.
- Donor Privacy
Personal information collected in connection with donations will be handled in accordance with the MotusAcademy Privacy Policy. We do not sell donor personal data. Donation data may be processed by service providers such as payment processors, website hosts, CRM platforms, or event systems where necessary to administer contributions.
- Transparency and Stewardship
MotusAcademy Foundation SD is committed to responsible stewardship of donor support. The National Council of Nonprofits notes that financial transparency and public disclosure support donor trust and ethical leadership, and that many nonprofits publish key information proactively to make trust-building easier. Where appropriate, MotusAcademy Foundation SD may communicate with donors about:
- the general purpose of supported work;
- programme updates;
- acknowledgement of support;
- legally required receipts and disclosures;
- major policy changes affecting donations.
- No Tax, Legal, or Financial Advice
MotusAcademy Foundation SD does not provide tax, legal, valuation, or financial advice to donors. Donors are encouraged to consult their own professional advisers regarding:
- deductibility;
- substantiation;
- valuation of non-cash gifts;
- estate, planned giving, or cross-border gift implications.
